Abstract

Economic Law has undergone significant transformation. It can no longer be viewed merely as a body of rules governing economic activities. It has increasingly evolved into a legal framework for regulating economic powers. This article examines the legal mechanisms designed to regulate such powers by distinguishing between those aimed at disciplining private actors and those intended to constrain public action. Adopting a systemic approach grounded in African and Congolese realities, the study highlights the emergence of a pluralistic regulatory model. This model combines competition law, contract law, sectoral regulation, compliance mechanisms, and the juridification of state intervention. The article concludes that Economic Law now plays a central role in structuring power relations within a context characterized by globalization and the growing plurality of normative orders.
